We summarize below the main labor law developments effective in early 2025, including updates to the Minimum Monthly Wage (IMM) and new obligations regarding workplace health and safety.
Increase in the Minimum Monthly Wage (IMM)
Effective January 1, 2025, the Minimum Monthly Wage is adjusted for inflation, reaching approximately CLP 510,500, subject to confirmation by decree.
Once the decree is published, the new wage will apply retroactively from January 1, and employers must recalculate employee salaries accordingly.
Implications:
- Increase in family and dependent allowances.
- Adjustment of the statutory profit-sharing cap.
- Increase in the non-remunerational minimum to approximately CLP 329,768.
- Increase in the minimum for employees over 65 or under 18 to about CLP 380,822.
Amendments to Internal Health and Safety Regulations
As of February 1, 2025, Supreme Decree No. 44 of the Ministry of Labor and Social Welfare comes into force, approving a new regulation on the preventive management of occupational risks.
This decree repeals Decrees No. 40 and No. 54 (1969) and establishes an updated, comprehensive system aligned with ILO standards, focusing on gender equality, worker participation, and continuous improvement.
Employer obligations include:
- Updating the Internal Regulations on Order, Hygiene, and Safety.
- Incorporating risk prevention mechanisms from the job design stage.
- Defining clear roles and responsibilities for all parties involved.
